Many years ago in a land far, far, away.........

I had a tower up with multiple antennas on it... for the first week it was
up, I left the feedlines coiled up at the bottom of the tower. I lived on a
Navy base at the time and had to jump through all the hoops to put the tower
up in the first place. I got a dozen complaints that first week....all were
for TVI. Turned out that there was a CB'er a block over running an illegal
amplifier.

I'm confused by the Homeowner's association statement that Federal law
overrides their restrictions. PRB-1 doesn't obviate covenant or private
land use regulations. If the homeowner agreed to deed restrictions on
antennas when he moved in then he should be complying with them.

This looks like one of those communities you can't do much of anything.
Why did he move there???

I haven't been able to find the covenants for the LakeRidge subdivision
in Lubbock online, but unless the restrictions really prohibit antennas
(and I doubt they do, the developer's comments notwithstanding) then the
ham was well within his rights to install whatever size antenna he
likes.

OTOH if the restrictions really do prohibit antennas then the ham would
have to have agreed to them at closing, and the antenna would be illegal
vis-a-vis his contract for sale. I don't think this is the case since
any casual reader of the FCC ruling (PRB-1) would know that.

They may sing a different tune when it is their hind-end that needs
help in an emergency. Although I think if I were him I would put up a
smaller beam just to be a little more considerate of the type of
neighborhood he is in.

I knew the neighbors didn't really like my tower and antennas, and I
recently took the tri-band beam down because I was going to
concentrate on 40 & 80 during the sunspot low. I may put it up again
one day, but for now I think they appreciate having just the 2-meter
beam on the tower. Of course I don't live in an area like that ham.
If I did, I probably wouldn't put up a tower in the first place.
Different strokes for different folks.
