Danny boy, there's a BIG difference between me and K1MAN, but you and
your little buddies on here are so stupid that you can't understand. The main difference is I pick a unused frequency and ask if the frequency is in use, and if no one answer I use the frequency. There's the BIG difference, between me and K1MAN, but hey, I'm talking to bunch of dumb narrow-minded licensed CB operators, who can't look outside the box. Secondly I don't have any Pecuniary Interest, But stupid people like forget that although there is a "banned" on Pecuniary Interest, Some Pecuniary Interest is allowed. For example, A person can order a pizza on a repeater, or if and a man and wife are both amateur operators she can call him on the radio and pick something up at the store. plus if your a club station and run a Information bulletin or morse code practice 40 hours a week (that's 8 hours a day) can compensate the control operator, so pecuniary interest is NOT complete banned from ham radio, but what would you know. Finally, Content, the FCC is prohibited for controlling the content of any station (47 USC 326) This has been upheld by the court of appeal and the US Supreme Court. but hey I bunch of cry-baby licensed CB operators who think they amateur's know. The rule dealing with the content of a Information bulletin can be found and is codified in 47 CFR 97.3(a)(25) Nowhere in 97.3(a)(25) or 47 CFR 97.111(b)(6) does it state an Information bulletin have to newscast, it only states that a information bulletin has to be directed to amateur radio operators, consisting solely of subject matter of direct interest to the amateur service. But, hey what would a bunch of half-wit licensed CB operators know. Todd N9OGL THE N9OGL SHOW 14.321.00 Saturday's @ 4.00 pm CST http://n9ogl.proboards50.com/index.cgi THE N9OGL BBS |

Toad N9OGL THE N9OGL SHOW SUCKS 14.321 http://n9ogl.WhoCares/index.cgi THE N9OGL BS First let me quote Dan/W4NTI "Tell me Toad, what has CB got to do with this discussion? Other than the obvious fact that it is where you learned all you "know" about Amateur Radio." Thanks Dan, I couldn't have said it better. Todd I seriously doubt that you have anything to say that would be of DIRECT INTEREST to the amateur service. You MIGHT have something to say that would interest a bunch of dumb, narrow-minded, cry-baby, half-wit, CB operators. But I doubt it. One last thing, since an_old_friend doesn't have a call sign his/her opinion is of NO relevance in an amateur radio news group. Just my 2 cents. Ace - WH2T |

First off Doc, how would you know, have you heard my bulletin?? Secondly and this is the important part, the FCC has stated it is up to the control operator of the station transmitting the Information bulletin to determine if it's of interest to the amateur radio service, NOT the people listening. http://wireless.fcc.gov/services/ama...ations.html#s3 Todd N9OGL |

What is an "information bulletin"? A. The term is defined in Section 97.3. It is a message directed only to amateur operators and consists solely of subject matter of direct interest to the amateur service. The control operator of the station transmitting an information bulletin is responsible for determining that the subject matter is of direct interest to the amateur service. That's the cite that you were too lazy to paste. There's a subtle but very important difference between what it says and what you purport it to say. It says that you, the control operator, are responsible for determining that the subject matter is of direct interest to the amateur service. It doesn't say you get to decide that it is. You must ensure that it is. You can be sure that if the FCC interprets your content as not of direct interest to the amateur service (most likely based on complaints of listeners) you will find yourself spending lots of time and money explaining why it wasn't. -- LRod Master Woodbutcher and seasoned termite Shamelessly whoring my website since 1999 http://www.woodbutcher.net Proud participant of rec.woodworking since February, 1997 |

Obscene and Indecent material falls under a different catagory, which
is the federal courts has ruled in the past that obscene and indecent material is not protected by the first amendment, while other content is. As I've stated before show me a final order or a rule that states an Information bulletin can not be opinionated. The FCC IMHO isn't going to go after some moron who gets on the radio spectrum and has a show, and he spews his opinion that a 4 bay antenna is a lot better in his opinion over a J-Pole. The REAL main difference between Broadcasting and an Information bulletin is a Broadcast is directed to the general public as a whole, while an Information bulletin is directed to a certain group. The FCC BELIEVES they can do what ever they want however the federal courts has REPEATIVELY said other wise when it comes to regular content, instead of Un-first amendment content. Todd N9OGL |
