Sounds like a good law. Why should Ham VHF handheld gear be any
different than cell phone stuff. Same thing distracting the driver. I
guess the big difference is that the newer cell phones are years more
advanced than the Ham stuff.

Very eloquently put! Your use of the word "stuff" indicates your mastery of
the English language. What the Hell does advancement of equipment have to do
with distracted driving laws anyway?

Ya'...cell phones are so advanced so Sally can call Bambie and tell her
about the new shoes she just bought at 50% off. All this while zooming along
at 65 mph. Let the cell tower go out and see if she can complete her
conversation about the matching handbag. I suppose that she could take a
picture of herself to see if her makeup is smudged, while the cell tower is
off-line (and stuff).

This is nothing new, except for extending existing laws to apply to
cell phone.

Any older, experienced ham can tell you that it has long been illegal
to communicate using your mobile rig while your car is in motion.

We've always been excluded for conducting a QSO while driving on public
roadways, so it makes sense to me that cell phone use should be equally
prohibited. The law makes sense.

I can't even count the number of times that I've had to take evasive
action to avoid collision with a clueless man/woman who is so
distracted by their cell phone conversation that they totally lose
sight of everything around them.

Just about like ole Rufus and lil Skippy yakking about the weather or
how Rufus ole lady has a hang nail.
Oh ya, my mastery of english was learned on the ham bands.

Eh? I hear all sorts of people chatting on the VHF/UHF bands while
they're driving in the morning. (Granted, I rarely participate, as
I'd rather not distract myself, but as far as I know, using CBs and
ham radios like that while driving is legal.)

Yes, but we're talking of the legality of using radios that aren't
held up to the ear. Instead, you've got a microphone with a PTT
switch and a speaker somewhere else.

Personally, I think it's about as distracting as a cell phone, and
prefer not to do so, but as far as I know, it's legal to talk on a
radio like that as long as there's nothing up to your ear. (And that
includes cell phones, as far as I know.)

(Of course, I'm in Texas. Other places may vary.)

The BIG difference is that as hams WE ARE Federally licensed and that
should supersede state or local laws!

I'm an older experienced ham and It has ALWAYS been LEGAL to use your
radio in you car while in motion.
There are many cases where a non-educated cop will give a ticked for
using your HAM radio in his moving car.
Once this goes to court 99.9 percent of these cases are dropped because
the cop is clearly wrong and did not understand.

Cell phones are different and should be BANNED in a moving car. many
people can't carry on a full dulpex conversation while driving. There
are MANY people who don't pay attention while driving because their
having a fight over the phone or just plain bull****ting.
