hoas found another way around the ban on them outlawing antennas

I just read in another newsgroup a post by a persn who lives in a hoa
He can not put up an antenna for broadcast reception even though
federal law says hoas can not prevent people from putting up antennas.

the way the hoa got around the dederal law is by outlawing him and
everyone from putting up any antenna masts at all..

Since they outlawed the antenna masts and not the antennas, as far as
the hoa is concerned, they'tre not breaking any of the federal laws
about them not being allowed to ban people from putting up tv
antennas.

To radioguy,

WHY do you keep posting pointless crap that simply doesn't matter to anyone except you?

Ham installations have federal pre - emption over any regulations that
hoa's, town or city governments, states, or anyone else can pass. the simple
solution for these people is to get a ham license, even a technician
license, which any 10 year old kid could get if he studied for a week, and
join the ARRL. Put up your ham antenna, or scanner antenna, whatever you
want to, and when they start giving you crap about it, call the arrl, and
tell them all about it.
then, sit back and see how they like getting fined 500 dollars a day for
interfering with a government emergency installation ! the FCC will come
down on them like a ton of bricks.... It really doesnt matter what the
antenna you put up is FOR, since if you SAY it's a ham antenna, it falls
under these protections. Endlessly bitching about it on these news groups is
not going to solve your problems. Remember this: ANY effort on their part to
prevent you from operating, putting up an antenna, ect, is going to be a
regrettable experience for them... One they will remember for the rest of
their miserable, controlling lives...

....

I believe that the amateur radio antenna preemption applies to regulations
by government entities only (zoning laws, etc.) and not to regulations by
private entities (HOAs). This is in contrast to the television antenna
preemption which applies to both of the above categories.

So put the antenna on your roof directly. It is fine that they can ban masts.
