Laws vary. You might try to do an internet of your state statutes.
Here is Florida it is prohibited with 3 exceptions. Newspaper agencys,
some Alarm Contractors and, fortunately for me, any person with a
valid Amateur Radio License.

I keep a copy of the my ham license and a copy of the statute with the
Ham license exception in my glove box because I don't expect our LE
agents to know everything.

That law is only if you have it in your car.

ignore the law the fcc says you can listen to any thing that is not
scarmbled or cell and that law over rules any stuped state alw I ahve
fought state laws and won
