That is an excelent suggestion, If that is you can identify him, and
prove he's violated laws (Which may well be the case here) and if his
ISP will cooperate then perhaps you can get him gone.

I remember one of my neighbors (if you call 30 miles neighbors) Sanford
(Spamford) Wallace of "Save a tree" fame. One of the first highly
prolific spammers on the internet.

Seems that one day a group of good old boys got together and started
pinging his ISP. Thousands of pings, non-stop for many hours, way more
than his Dearborn Michigan based ISP cold process, Brought them down,
Now understand that they have dozens of legitimate business clients who
were, quite logically, peaved. So they identified the source of their
irritation and pulled Spamford's plug. suddenly the ping attack vanished.

(Please note my only part in this was as an observer after the fact, By
the time I knew what was going on the attack was history, I had nothing
to do with it, DNS attacks such as this are illegal)

Well Spamford sued, seems his contract with his ISP said they had to
give him 30 days notice.. IT is at this point he made the newspapers and
I got to read about it. The judge took 2 weeks to decide the case, her
decision (Which I applaud) was "Yes, they have to give you 30 days, so
they have to hook you back up but 30 days from the day they first
pulled the plug, they can pull it again. (And so they did)

The good old boys who did the DNS on the ISP, were satisified and
respected the court's decision, gave the ISP the two weeks unmolested
and then ... The ISP did not need to be warned twice they pulled the plug.

Last I heard Spamford was having a bit of a problem finding a new host
so he tried to become an ISP himself but those who administer the net
would not grant him a domain name. Gee.. Sucks to be him.

I'm not suggesting this be done to our spammer here

but if enough folks send enough E-mails to his ISP, they are going to
have a problem with their postmaster's mail box

So if someone would post the E-dress of his postmaster... I'd be happy
to send an E-mail of complaint

Thanks for the offer to help us out in this very frustrating quest. The
spewer makes no bones about his identity as he continues to flood the
rec.radio.amateur.policy news group. Just yesterday, he posted 400
similar messages to rec.radio.amateur.misc and rec.radio.amateur.policy,
and then bragged about it athttp://khkb9rqz.blogspot.com.

His name is Mark Morgan - amateur call kb9rqz - and he resides in
Chassell, MI. His ISP is HughesNet (direcpc), and his NSP of choice is
Teranews (nntpserver.com). Teranews is located in Osceola, IN and
shares the same building and telephone numbers as Nibble Net. Teranews
has a black hole into which all emailed and surface mailed complaints
are tossed. They also rudely reject telephone calls.

Their abuse address is .

Mr. Morgan is also in ongoing violation of the terms and conditions
which HughesNet has published at http://tinyurl.com/2o7ppq, but HughesNet
also ignores complaints to their abuse department (which was once listed
as , but which can no longer be found in the whois data
bases. Attempts to query whois information for hughesnet.com result in
server rejection messages).

People have surface mailed HughesNet but have received no response.

Mr. Morgan has issues and does not operate under the same set of
motivations and constraints that guide other people. I am convinced
that the only way to put a stop to his floods is to have his Usenet
access removed.

As to illegal behavior, Mr. Morgan has already reported an uninvolved
amateur radio operator to child protection services in both the states
of Pennsylvania and Florida as a suspected child molester. Mr. Morgan
did so because he incorrectly identified one of his protagonists as
that uninvolved individual. Mr. Morgan is also suspected of authoring
anonymously emailed death threats (he has a unique writing style which
is hard to disguise - see his web site for examples).

Sorry for the long post, but this is a longstanding and pernicious
situation. The news group rec.radio.amateur.moderated was created
largely to get away from Mr. Morgan's floods, but that does not solve
the original problem of the destruction of two once useful news groups.
Even worse, Mr Morgan has now been branching out to formely unmolested
news groups and has begun posting his spews there.

He is basically hiding behind two rogue service providers, and has so
far been untouchable. It is extremely frustrating.

P.S. Expect him to join this thread and to claim that he is being
discriminated against because of his lifestyle. According to him, that
ploy has worked wonderfully well with HughesNet, and he brags that he
will never be ToSed by them.

at this point, it no longer matters.

both of you have had a long running feud that has ruined more than a few
newsgroups and driven technically minded folks from these forums without
regard to consequences.

since both of you are known quantities, it isn't that hard to discover your
localities, monitor you and report those findings to the relevant agencies
for proactive handling.

since neither of you is willing to give it up, then the rest of us will
simply move to where you cannot come. you'll be all alone here, in the
dark, stroking yourselves into total insanity.

as for Hughes.net and their lack of "responsibility, its rather simple to
take care of them. get hold of their upstream and let that upstream know
they have a problem with a rogue ISP and abusive ops therein. Hughes will
shape up and dump the offending users or face disconnection (that means
real $$$ there folks).

That is the method that gets result. start hitting the upstream providers.
they won't allow this type of behavior to continue.

Well both false police report and wire-threats are crimes.

There was a case here in Michigan in fact (I think it was tried in Wayne
county though it occurred in Washtanaw, Alas, the defense won IIRC)
where a man (College student) posted a fantasy, This fantasy, clearly
labeled as such, was called a threat by the prosecution and ... Well,
the fact that it was clearly labeled fantasy is why the defense won.

Had the thread not been so labeled... The case may well have turned out
differently, There were a few other "Issues" with the case. Such as
they charged the boy with sending threates interstate by wire. The boy
never, near as the prosecutor can tell, sent any message to the young
lady. Nor did they claim he intended to. He sent a fantasy story to a
friend out of state and somehow it got to the authorities and THEN back
to the young lady. THEY (The prosecutor) Transmitted the threat to her.

Like I said, that case had more holes than a colander.

But if he's making real threats.. He should be caged

As for Hughes net..... I have a few side doors there, It will take a
year or two (Financial issues) But I may be able to sit down and have a
cup of coffee with someone who has a much bigger voice at Hughes than I
do. We have met, and when we are in the same neighborhood my RV tends
to "Stand out" a bit from the crowd (Has to do with the site marker, not
the RV) making it real easy to find. I mean REAL easy to find.

Hughesnet is my other ISP

One nice thing ..... If he spams enough he will trip Hughes FAP which
shuts him down to dial up for 24 hours

Oh, almost forgot. Since he is a licensed ham radio operator (or claims
such) the FCC might be interested too. They have lately been pulling
licenses for non-radio related offenses due to the "Character of the
licensee"

I'm not convinced the FCC should be doing this (I'm also convinced they
should NOT be doing it, I'm basically sitting atop the fence on this
issue, no argument either side, would be interested in hearing learned
argument but frankly this is the only comment I have at the moment, my
position is dead center +/-0) But they are doing it.

I doubt however that pulling his license would have any effect on his
spam save, possibly, to increase it

funny thing is that the mater has been reffered to the FCC anf I have
discussed the matter with RH himself andf he agrees I am within my
rights, although he wishes I would choose a differnt tac
