Basically the same 'criteria' that present day Analog Radio Listeners have had to deal with : You can't hear everything and you can't always hear what you want : So Hear What You Can - When You Can : Can It All . . . It's Only Radio ! Whether 'we' here as AM/MW Radio DXers like it or not : In the long run HD-Radio will serve the American Audio Consumer : Who is a regular Listener of Free Over-the-Air AM & FM Radio. HD-Radio will meet the 'needs' of the "Vast Majority" of the American Audio Consumers : Who Choose HD-Radio. You also point out one of HD-Radio major problems : quality e-q-u-i-p-m-e-n-t . The 'other' on going problem is the HD-Radio Signal Delivery. The 1% Solution Ain't No Solution At All : with a Bump to 4% the First in a Series of Digital Power 'adjustments' over several Years { ~ Decade} toward the Full Transition to All Digital AM & FM HD-Radio with the end of all Analog AM & FM Radio Broadcasting. The FCC 'claims' that they will let the Market Place "Decide" * The Fact-Is that the Market Place is the Radio Broadcasters and Their Advertisers : Not the Radio {Consuming} Listeners. * Presently Analog Radio is Paying the Bills and HD {Digital} Radio -is- a "Cost". * In the Future there will come a "Time" when HD {Digital} Radio is Paying the Bills and Analog Radio -is- a "Cost". * When That "Time" Comes : The Radio Broadcasters and Their Advertisers will 'petition' the FCC to drop the imposed Cost of continued Analog Radio Broadcasting and the FCC will readily agree : Since by doing so the FCC would itself eliminate an Administrative Function and achieve a Cost Saving for the Government. |

If it was their name and what they do or manufacture would not be mentioned. They want to be thought well of so you will buy the product or service. This is very transparent and if you don't see it I don't hold much hope for you. I don't care about the legalese. Non coms can have "commercials" but there are restrictions on them, such as no "call for action" and no price-item type ads. However, a commercial can describe the merits of a business or product. An example would be Mercedes can describe the design and careful attention to detail and safety and the power of its engines, but not the $399 a month lease terms for well qualified customers. It's an ad, but with restrictions.... very significant restrictions. As was said, check with a lawyer... any communications attorney can tell you the differences between ads on a commercial and non commercial station. |

I remember back when there actually were non-commercial stations. There certainly are commercials, but the content is severely limited. From today's Inside Radio, a news item that defines to some extent what can and can't be in a non-com's "underwriting" announcements which are simply commercials without the hype. Non-commercial station fined for plugging sponsors' products. Contemporary Christian "92.7 The River" WCVZ, South Zanesville, OH is being hit with a $9,000 FCC fine for broadcasting prohibited underwriting announcements in 2003. The case involves underwriters Tastee Freeze and Prindle-GMAC Real Estate. In the Tastee Freeze instance, WCVZ asked listeners whether they are "planning a special occasion" - a move the FCC says "might require use of the underwriter's products." Owner Christian Voice of Central Ohio argues the comments are acceptable because they don't contain price information or calls to action. But WCVZ is fined because the FCC says announcements that feature "comparative or qualitative descriptions, price information, calls to action, or inducements to buy, sell, rent or lease" are prohibited. The station has since converted to a commercial operation. |

And reality is that there is no difference. Check with a lawyer....there is. Sorry bud, a private corporation pays and gets mentioned as supporting the program. You think that's done for altruistic reasons? Absolutely not.... But it's like someone getting their name listed as a donor at a museum. But it's more a question of what you call it. Semantics. As Eduardo pointed out, there are things that can make a difference as defined by law. Non coms can have "commercials" but there are restrictions on them, such as no "call for action" and no price-item type ads. However, a commercial can describe the merits of a business or product. KPFK is protected only to the extent of a conforming B contour, which ends in deep Orange County. No LA FM is protected into San Diego County. XHLNC is a legal operation. Legal schmegal, it still is jamming KPFK No, it is not. Class B "grandfathered" FMs are only protected to the distance of the protected contour of a standard B with 50 kw at 500 feet, not the grandfathered extra coverage which is not protected at all. XHLNC does not have any overlap with the KPFK protected contour. Second, XHLNC (there is no XLNC) is moving to another frequency. They already have lit up 104.9, but continue to simulcast for the only ostensible purpose of jamming. Why not kill the 90.7 signal? They have not fully moved because of licencing issues with 104.9. 104,9 has ammended its technical application, and will be a licensed station as opposed to a permit based station... a signficant change of class in Mexico. All of this is sitting at the SCT right now. And they can not jam a signal that is not legally required to be protected in their coverage area. Ya know fracklestein, you just like to try and nitpick your way out of the losing corner of an argument you painted yourself into. The argument is simple: KPFK is protected ONLY to the extent of the protected contour of a standard B of 50 kw at 500 feet HAAT. That contour ends in Orange County. The XHLNC contour does not interfere with the standard B protection requirements, and is thus neither a "jammer" or "illegal." It is so legal that it was approved years ago by the Comisión Mixta of US and Mexican authorities which governs the border zone; Mexico has a right to use the spectrum, too. |
