eBay horror story
 
I bought a radio described as in very good condition. when I got it, I would
rate it fair to good. when I wrote the seller, here was his first response:

I am sorry to hear that but this item is being sold
as-is. This was listed
very clearly. There is nothing we can do for you on this item.

Sorry I couldn't be more helpful.



no where did he address that he was not giving the truth in the auction.

when I told him I would have to leave a negative for him, here was his
response:

Expect a negative in return for a buyer who doesn't read
auctions and is quick to leave negative feedback. Hope
your perfect record is worth it.


now where does "as-is" mean you can LIE about the item you are selling ? How
was I quick, I wrote him and he told me tough luck !

this is an area where the eBay system is seriously flawed. How can I give a
negative without getting one I don't deserve. maybe a class action alw suit
is in order here !

My first question would be whether your idea of very good condition is
the same as the sellers. Also, were there pictures you were able to
look at? Believe me, I sympathize with you but if the auction said "as
is", you really have no recourse and I don't think the bad feedback is
worth what you *won't* gain from it. Sometimes I hate the "system"......

sadly, 'as-is' pretty much does allow him say anything about it he likes --
particularly as there is no official meaning of 'very good condition'.

He was in very good condition -- for a dead guy.... (for example)

You have to ask questions, I haven't been burned yet. The only thing I
have ever bought that didn't work perfectly was the Hammarlund HQ-100 I
bought. A wire broke off during shipping, and it did nothing but buzz.
The thing was so heavily modded I had no clue where it went, with 3
added tubes and no schematic, I wasn't looking forward to having to
screw with it. Luckily, I found the end of the broken wire, and got it
going.

I always ask, "Is there anything wrong with it?" So far, the answers
have always been "No". ANd they were telling the truth.

The only problems I had selling something was when a buyer tried to
claim an expensive receiver I sold him wasn't working right. He wanted
to keep it, with a partial refund, of course. I had him send it back and
I refunded his money. The radio worked perfectly for nearly a month
straight, and then I put it up for auction again, and got a much lower
price for it, but the buyer was very happy, and he should have been, as
it was in mint condition. He paid about the same as the first guy wanted
to pay. That's how it goes..

Read through the ebay website rules about leaving feedback. Find out the
length of time you have to leave feedback; this used to be 90 days 3 years
ago, which is why I'm saying you should look it up.

Calculate the date 90 days (or whenever) from the date the auction ended.
Circle the date on your calendar. Remember the time the auction ended.
Simply leave negative feedback less than an hour before the feedback
expiration period.

I know this might sound kinda dumb, but it is the best shot you have at
leaving a well-deserved negative feedback without receiving a retaliation
feedback in return.

Depending on the details, you may be able to file a complaint of
misrepresentation, and a claim for reimbursement through ebay.

I'd do this before filing a neg.

If they agree the listing wasn't honest, they're likely to offer him the
chance to make good or get naru'd if they have to pay the claim. That's
likely to mean more to him than a neg.

Of course he may still neg you.

I made a claim a few years ago when a seller took the money and ran.
IIRC, they had a $25 deductible, and a $200 limit (really $175 after the
deductible.) You need to follow up on things as they have narrow time
windows where you need to take action to pursue the claim.

I've been lucky with Ebay so far, but your experience is why I'm still
very cautious about using them. I find that calling the seller and
talking to him is one way to get a pretty good idea about whether he can
be trusted. Most people don't lie well on the phone when they have to
answer questions quickly. Hope you get some satifaction with Ebay.
