Cheap Chinese HT's are illegal
 
According to the FCC, the cheap Chinese-made 2-meter and 440 HT's are

It is unlawful to sell uncertified/type accepted equipment. It is NOT
unlawful to own or use such gear in a legal manner in the appropriate
amateur frequency allocated band while adhering to FCC rules and regs
regarding RF emissions for that particular band and license class.

unlawful to own or use such gear in a legal manner in the appropriate
amateur frequency allocated band while adhering to FCC rules and regs

The units were advertised in a web catalog for sale as new radios for use
from 137-174 MHz and 400-470 MHz. _ OOPS!!

There is a BIG difference between Type Accepted units, that ARE REQUIRED
for Professional and Government Radio Services and non-Type Accepted
Units that can be used in the Amateur Radio Services..... Equipment for
the Professional and Government Radio Services must at minimum be Part
15 Certified, and if intended for sale in a Licensed Professional and
Government Radio Service must be Type Accepted, BEFORE it is offered For
Sale. This is STILL NOT the case for equipment used in the Amateur Radio
Service. In our service, equipment Imported for Sale, I believe must be
Part 15 Certified, but other than that there is no type Acceptance
Requirement. Equipment built by local hams that is NOT For Sale, does
NOT even Require Part 15 Certification.....

Actually radios are no longer "type accepted". They receive an FCC ID
number. I have a Motorola commercial radio for work and an Icom T90 HT
for ham and both have an FCC ID number. You can go to the FCC website,
plug in that number and get info on the radio.
