eBay is simply a haven for thieves. Where else can you advertise a $1000
radio for sale --- and then say in fine print at the bottom "all sales
final - no returns or refunds - sold "AS IS"... ???
People here in the radio newsgroups that have tried to sell anything with
those "eBay terms" haven't had much luck in selling their junk.
Ebay is here to stay - but it's a shark infested pool - and a haven for
crooks.

A California appeals court has handed down a ruling which shields eBay
from being sued for content which is provided by a third party. This
may have some effect on eBay's liability for posting messages for
illegal CB amplifiers. See the story at: (cut and paste if necessary)

Here is the significant quote from the article:
"The federal law cited in the ruling was enacted as part of the
Communications Decency Act, itself part of the 1996 Telecommunications
Act. It says that "no provider or user of an interactive computer
service shall be treated as the publisher or speaker of any information
provided by another information content provider."
This particular ruling involved eBay's responsibility for hosting
negative feedback from a dissatisfied customer and does not specifically
mention any product type, but the connection is obvious.
Well thought out flames welcomed. Poorly conceived or badly written
flames will be ignored. Fire away.
