I would suggest you contact WA5WHN and ask him about it.

I took my own advice and asked WA5WHN about it via email, and he's being
tight-lipped about it, insinuating that the FCC will be doing something
about it soon or at least issuing a statement sometime in the future. So
ignore what I said, I don't think that Mr. Miller wants any more email about
the subject. I guess we'll have to wait & see what comes.
