sell it to them, but it's not illegal for them to try to buy it from

In many states it is illegal for a minor to buy, possess or use tobacco
products. If a store sells tobacco to a minor, the minor is in
possession, and both store and minor can be prosecuted.
Attempting to do an illegal thing can usually be prosecuted as well.

Of course the enforcement of these laws is uneven at best. But here in
EPA, most stores will require ID of anyone who looks under 25 years of
age before they will sell them tobacco products.
