Amateur radio operators are responsible for their emissions. The FCC could
care less about an amateur's equipment as long as the emissions are within
spec.

It IS illegal to sell such equipment in the USA. It is NOT illegal to buy
and use it, if you are a properly licensed amateur radio operator. Once
again, amateurs are responsible for the quality of their RF emissions. They
are not responsible for their gear having type certification. The
manufacturers and the retailers are responsible for having proper type
certification.
