According to Stanford Law School's web page:

"Fair use is a copyright principle based on the belief that the public
is entitled to freely use portions of copyrighted materials for
purposes of commentary and criticism."

Cunningham was not using "a portion" of a photo, nor was he engaging
in any commentary or criticism of the photo. He was stealing it, and
he broke the copyright laws.

And by the way, there is nothing explicitly stated in the law about
attribution at all.
