In law it isn't taken as necessary false but an alteration of the original position. Here's how it's used. A plaintiff, say, pleads a contract against you when its existence is by no means certain. You plead back that no contract exists but there was a relationship and you've been damaged in tort. So, it is kind of a dance where you position your opponent to be slayed by your arguments.
