Empire State Building Wins Summary Judgment Against WBAI In Rent Dispute

Judge Gerald Lebovits has ruled with a summary judgment in favor of the
Empire State Realty Trust in its lawsuit against Pacifica Foundations 99.5
WBAI New York for unpaid rent in the amount of $1,819,687.52.

WBAI had sought to continue to pay the $12,000 a month as opposed to the
nearly $45-$53,000 per month its lease was for on the argument that they
had an oral agreement, but the judge ruled that there was no written
agreement to go along with it. In a statement on WBAI.org, Pacifica lawyer
Sam Himmelstein stated This was about as bad a result as we could have
expected.

Pacifica must pay the money due immediately. In an audio clip on WBAIs
page, General Manager Berthold Reimers made the argument that WBAI or any
station should not have to pay any money for a tower lease because it is a
publicly licensed operation. Pacifica states that it intends to use
Political Pressure to get the judgment overturned.

WBAI holds a Construction Permit to relocate to 4 Times Square with
10kW/282m, but is contractually bound to the Empire State lease for a few
more years.

Original Report 1/30: The ongoing saga of the Pacifica Foundation and its
stations attempts for survival has taken another turn as a lawsuit filed by
the Empire State Building over unpaid tower rent by 99.5 WBAI New York has
been made public.

The ESB sued Pacifica in November 2016 for the $1,357,429.71 owed in rent
and late fees plus interest, costs, disbursements, and attorneys fees.
WBAIs lease runs contractually through 2020 with the station paying for
tower and combiner space, backup antenna/combiner, and a transmitter room
on the 81st floor.

WBAI holds a Construction Permit to relocate to 4 Times Square should it be
evicted from the Empire State Building that expires in July. But with the
Pacifica Foundation struggling survive, a judges ruling to force payment
could help expedite whatever the group needs to do to raise funds.

So let me be clear, I like Connoisseur’s Mod 102.3 W272DO/WPLR-HD2 New
Haven, Conn., Â*which launched last month with a pop-leaning Alternative
format that it positions on the air only as “The New Sound of New Haven.� I
had tweeted my intended approval of the station’s segue from R&B artist
Khalid to “The Man� by the Killers, adding “because once you decide that
the Chainsmokers are alternative, keep going.�
A few hours later, Keith Dakins, PD of Mod and its Connoisseur/Connecticut
rock brethren, tweeted back, “Wait are you making fun?! We never use word
alternative on air and remember KROQ in the 80s played Prince, Bob Marley
and more.� I tweeted, “No Im with you. I fought that battle for years. Im
glad youre doing this.� You can blame any misunderstanding on Twitter’s
required terseness. A few more characters and I would have written “please
keep going.�
There are two things going on here. One is that programmers have been
struggling with the Pop/Alternative hybrid for more than 20 years. WHTZ
(Z100) New York seemed to get it right for a while in 1983-84 and then
listed to the extremes. Late ‘90s Modern AC was phenomenal, but ran out of
defining product when Alternative tilted to the harder side.Â*
There’s also been the issue of R&B and Hip-Hop at Alternative. KROQ played
Prince and Rick James. I even remember KROQ spiking an R-rated novelty by
my ‘70s R&B hero Millie Jackson once. For the most part, though,
Alternative has played the Beastie Boys and Eminem but not 2Pac and Dr.
Dre. (Many years later, I saw an Alternative station test Dr. Dre and even
“Just a Friend� in a library test, and, at least at that point, the
audience liked both equally.) When PDs bend the format for the Chainsmokers
(and, even in this case, Robyn), they do not necessarily keep going.
I tackled the pop/alternative issue 18 months ago, and even then I wrote,
“How can you deny the hip credentials of The Weeknd or Kendrick Lamar?�
What Mod 102.3 has done was a more-than-logical move for a format that has
long become an alternative pop universe. Most of today’s pop music owes
something to “Midnight City� by M83. Most alternative artists lean pop. Of
course Khalid fits.
Mod 102.3 launched the same week that KSXY Santa Rosa, Calif., which had
been interesting in a number of ways as top 40 Y100.9, switched to its own
pop/alternative hybrid. KSXY owner Sinclair had occasionally done something
similar on WROX Norfolk, Va., but couldn’t fight the rock history of that
frequency. KSXY’s new incarnation as “The 101� and Mod’s appearance on a
translator have the advantage of starting clean, coupled with the “bonus
success� nature of FM translators, in Mod’s case.
The presentations are very different, but I’m enjoying Mod 102.3 the same
way I did the early hybrid format at Z100. The latter station had Z100’s
inherent Top 40 hype and swagger. Mod 102.3 talks over intros, but in a
more low-key manner, similar to WRFF (Radio 104.5) Philadelphia. There are
attitude sweepers — “stop listening to your older sister’s terrible music,�
commands one. The current ticket giveaway was to see Phoenix — one of the
bands that has been leading Alternative in a more pop/dance direction for
more than a decade.

Hutton Broadcasting flipped Talk 101.5 The Voice KVSF-FM Pecos/Santa Fe NM
to Jazz 101.5 The Cat on September 15.

Positioned as Santa Fes Community Jazz Station, the station is featuring a
mix of modern and classic Jazz tracks from the past century. The Cat name
was previously utilized in the market by then Clear Channel owned 101.1
KSFQ during its run as a Smooth Jazz station from 2005-2007.

Richard Eeds, who had hosted mornings on The Voice, stays in mornings for
The Cat, but adds a new talk show from 1-5pm on sister Liberal Talk 1260
KTRC/103.7 K279CX. Nacha Mendez will host middays from 11am-3pm and Ira G
afternoons from 3-7pm on KVSF-FM.

Woof Boom Radio Expands To Lafayette IN

Woof Boom Radio is purchasing 106.7 WKHL West Lafayette IN from Educational
Media Foundation for an undisclosed amount.

Jim Stone will join the company to serve as Managing Partner for Woof Boom
Radio Lafayette. Stone most recently ended 17 years in mornings at Midwest
Family Broadcastings Rock 104.9 The X WXRX Rockford IL and as OM/PD for
other stations in that cluster. He also has programmed 107.5 WZZQ Terre
Haute IN.

EMFs K-Love Christian AC programming will continue to be heard in the
Lafayette market on 88.9 WLXJ Lafayette.

Announcing the acquisition of WKHL 106.7 FM, West Lafayette, Woof Boom
Radio continues its mission to build out great locally managed and owned
radio stations. Woof Boom Radio began with a vision of great radio that
focuses on service to the local community. Woof Boom, with this newest
addition, becomes a station group operating in three markets in Indiana and
Ohio.

Pending FCC approval, Educational Media Foundation (EMF) will sell WKHL FM,
West Lafayette to Woof Boom Radio.

The station will be run by Woof Boom Radio Lafayette Managing Partner, Jim
Stone. Stone, a long-time radio veteran returns to Lafayette. “We will
program and format this station to meet the needs of the people of
Lafayette�. Stone continued, “This is a rare opportunity to create a
station from the ground up, and once we do, we will build it and then run
it to serve the listeners of Lafayette.�

The acquisition of WKHL follows last month’s acquisition announcement by
Woof Boom Radio of The Childers Media Group in Lima, Ohio.

Stone is the former program director, operations manager, and on-air
personality for a group of radio stations in Rockford, Illinois. “I worked
with Jim Stone for nearly a decade. He is a natural leader and a great
broadcaster,� Woof Boom Radio President J Chapman remarked. “Jim, as part
of our ownership group, will not only be invested in the community, but I
know that he will work to make a difference in Lafayette.�

The station is anticipated to close in late 2017.

Neil Larrimore Joins WPRO As Program Director

has appointed Neil Larrimore as its new Program Director.

Larrimore programmed iHeartMedias Talks and Sports stations in Phoenix and
Tucson AZ until his exit in June. He has also spent seven years programming
KMBZ Kansas City and time as APD at WHIO Dayton and WWDB Philadelphia.

Larrimore replaces Tony Mascaro who departed WPRO/WEAN-FM in June.

Cumulus Media announces it has appointed programming professional Neil
Larrimore as Program Director for News/Talk station WPRO-AM in Providence,
RI. Larrimore has programmed successful stations for more than 20 years and
joins Cumulus from iHeartMedia, where he was formerly Program Director and
Brand Manager for iHeartMedia’s Information brands in the Phoenix, AZ, and
Tucson, AZ, markets. Prior to that, he was Program Director for KMBZ-AM/FM
in Kansas City, MO. He has held other programming positions in markets
including Dayton, OH, and Philadelphia, PA. Larrimore holds a Bachelor’s
degree in Communications from Temple University.

Melany Myers Takes Middays At K104.7 Charlotte

Beasley Media AC K104.7 WKQC Charlotte has appointed Melany Myers as midday
host.

Myers previously spent sixteen years at iHeartMedia Charlotte where she was
at Classic Rock 99.7 The Fox WRFX and part of the Woody Wilcox show on
Alternative 106.5 The End WEND. She also spent a few years in middays and
afternoons at Alpha Media Rock Fox 102.3 WMFX Columbia SC.

Myers replaces Brenda Matthews who exited in the midday daypart.
