The FCC says we are required to implement both good engineering
practice in the establishment and operation of our stations, and we are
to implement "good amateur practice" in the establishment and operation
of our stations.

The FCC has said that compliance with bandplans establishes good
amateur practice.

Violation of that caveat will get you "violated".

That's only partially true. One can "violate" the band plans and not
necessarily be considered a candidate for enforcement action. It generally
needs to be in combination with other factors. Afterall look at every
contest. In general, there are many operations in "violation" of the
bandplan. In voice contests, the operators do not stay out of the SSTV
segment. In CW contests, they do not stay out of the RTTY segment. RTTY
contestors spread out just like everyone else and do not stay in the RTTY
segment.

If a person makes sure the frequency is not in use and is legal by
regulation for that form of operation, they will not be penalized for not
following the band plan.

Absolutely correct, Dee...

It's just like speeding...Don't do it in a school zone or right in
front of a cop, and it's not likely to draw the ire of the cops...But
make a point of being an idiot about it, and you're going to get your
chops busted for it.

Not often, even when it is cited, the violation has to be deliberate,
persistent, and outrageous.

Listen to the CW bands on any CW contest weekend, or the Phone bands on any
Phone contest weekend, and you'll find the bandplans exuberantly ignored by
hundreds of stations.

Look at the bandplan for 160M with a window 20kHz wide at 1830-1850 reserved for
intercontinental QSO's only. Just for ****s and grins I just tuned that segment
and found 6 NA-to-NA contacts ongoing. Do ya think they'll get tagged by Riley?
