While you are totally correct in it being legal for the present owner, didn't the same law make it illegal to resell it?

The Realistic Pro 2006 Scanner did not come from the factory with cell
phone frequency coverage...it's specifications lists a reception gap
of 868.945 MHz-898 MHz...it required a modification to restore this
frequency gap (open up, clip 1 diode) very simple mod...but making it
technically illegal to own, operate, or sell. As the previous
Gentleman pointed out the seller can get the point across by adding
"YES. IT DOES"...if the seller lists "continuous coverage"...does eBay
pull the auction?..."YES.THEY DO!"

Not to defend, but you better look at that auction again, and open you eyes
this time... There is a "Buy-It-Now" price listed, therefore it is in fact
FOR SALE as well as FOR AUCTION...

Two different things, YES. But, in this case it is BOTH things, not just
one...

This has been covered several times.

eBay *does* allow the sale of pre-ban scanners which *can* be modified to
receive cellular frequencies.

eBay *does not* allow the sale of such scanners which are advertised as
modified, cellular capable, full 800Mhz, open, receives cell phones,
modifiable, or any similar verbiage.

They have also been known to pull auctions where "YES IT DOES", "if you know
this scanner, you know what it can do", "one of the good ones", etc.

Ditto for items including photos which show a cellular frequency being
displayed. (I always thought this was a very clever way of getting the point
across, BTW.)

If you want to sell a pre-ban scanner on eBay, simply list the model number and
the date code. Those who will bid highest are familar with the date codes and
know which scanners are modifiable, based on the combination of model number
and date code.

Do not make ANY reference to the scanner being modified or modifiable. Do not
make ANY reference to cell phones, cellular, or cellular-capable. Do not
reference ANY frequency range other than that provided by the manufacturer
(with the required cell gaps.)

This will allow you to sell your scanner without incurring problems from the
eBay police.
