Thanks for the offer to help us out in this very frustrating quest. The
spewer makes no bones about his identity as he continues to flood the
rec.radio.amateur.policy news group. Just yesterday, he posted 400
similar messages to rec.radio.amateur.misc and rec.radio.amateur.policy,
and then bragged about it athttp://khkb9rqz.blogspot.com.

His name is Mark Morgan - amateur call kb9rqz - and he resides in
Chassell, MI. His ISP is HughesNet (direcpc), and his NSP of choice is
Teranews (nntpserver.com). Teranews is located in Osceola, IN and
shares the same building and telephone numbers as Nibble Net. Teranews
has a black hole into which all emailed and surface mailed complaints
are tossed. They also rudely reject telephone calls.

Mr. Morgan is also in ongoing violation of the terms and conditions
which HughesNet has published at http://tinyurl.com/2o7ppq, but HughesNet
also ignores complaints to their abuse department (which was once listed
as , but which can no longer be found in the whois data
bases. Attempts to query whois information for hughesnet.com result in
server rejection messages).

People have surface mailed HughesNet but have received no response.

Mr. Morgan has issues and does not operate under the same set of
motivations and constraints that guide other people. I am convinced
that the only way to put a stop to his floods is to have his Usenet
access removed.

As to illegal behavior, Mr. Morgan has already reported an uninvolved
amateur radio operator to child protection services in both the states
of Pennsylvania and Florida as a suspected child molester. Mr. Morgan
did so because he incorrectly identified one of his protagonists as
that uninvolved individual. Mr. Morgan is also suspected of authoring
anonymously emailed death threats (he has a unique writing style which
is hard to disguise - see his web site for examples).

Sorry for the long post, but this is a longstanding and pernicious
situation. The news group rec.radio.amateur.moderated was created
largely to get away from Mr. Morgan's floods, but that does not solve
the original problem of the destruction of two once useful news groups.
Even worse, Mr Morgan has now been branching out to formely unmolested
news groups and has begun posting his spews there.

He is basically hiding behind two rogue service providers, and has so
far been untouchable. It is extremely frustrating.

P.S. Expect him to join this thread and to claim that he is being
discriminated against because of his lifestyle. According to him, that
ploy has worked wonderfully well with HughesNet, and he brags that he
will never be ToSed by them.

Oh, almost forgot. Since he is a licensed ham radio operator (or claims
such) the FCC might be interested too. They have lately been pulling
licenses for non-radio related offenses due to the "Character of the
licensee"

I'm not convinced the FCC should be doing this (I'm also convinced they
should NOT be doing it, I'm basically sitting atop the fence on this
issue, no argument either side, would be interested in hearing learned
argument but frankly this is the only comment I have at the moment, my
position is dead center +/-0) But they are doing it.

I doubt however that pulling his license would have any effect on his
spam save, possibly, to increase it

funny thing is that the mater has been reffered to the FCC anf I have
discussed the matter with RH himself andf he agrees I am within my
rights, although he wishes I would choose a differnt tac
