If he were
operating legally, this translates into a few hundred feet at best and
means a transmitter power of only a few milliwatts (typically in the
6-20 mw range).

In reality, radiating even 6-20 _micro_watts would be too much for legal
operation under Part 15 FM (see my earlier response in this thread).
