I challenge anyone here to show me in the FCC regulations that it
illegal to sell a scanning receiver that was manufactured prior to April 1994. The FCC stated in Section 15, CFR 47, "...Further, scanning receivers that comply with the current rules will be permitted to be manufactured or imported into the United States for up to one hundred and eighty days after publication of this Report and Order in the Federal Register. However, equipment manufactured or imported into the United States after one hundred and eighty days from the date of publication of this Report and Order in the Federal Register must comply with the new rules." Further........ Section 15.37 Transition provisions for compliance with the rules. (f) The manufacture or importation of scanning receivers, and frequency converters designed or marketed for use with scanning receivers, that do not comply with the provisions of § 15.121(a)(1) shall cease on or before April 26, 1994. Effective April 26, 1993, the Commission will not grant equipment authorization for receivers that do not comply with the provisions of § 15.121(a)(1). This paragraph does not prohibit the sale or use of authorized receivers manufactured in the United States, or imported into the United States, prior to April 26, 1994. This makes it pretty clear that selling a BC200XLT does not in any way violate Section 15 of CFR 47. USING the scanner to listen to cellular frequencies is another matter, and is prohibited. Some post also ask if this was a trunking scanner? If it's not trunked, you're going to sell a basically worthless piece of gear because, excluding cell in the 800 meg band, the only other thing there of interest is police and they are practically all, trunked. The guy is trying to say it's against the law to sell equipment that is not blocked for illegal freqs like the 800 meg band, that's all. He then says you are selling a radio for a premium price that isn't going to copy much of what is going on with the 800 meg band. Pure and simple since you're talking about simple. YOu mention lid but if you are not aware of cell blocked 800 mhz requirments and trunked capabilities that your radio doesn't have, you might be the lid. If you have bad day, keep it to yourself and don't be a dick to the whole world. |
