It's not a theory. The FCC very clearly stated in their clarification
memorandum of March 29, 1999 that, in the rules for blocked scanners,
there was no intention to prohibit the sale of pre April 1994
scanners. Note that this memorandum was issued some 5 years after the
rules were published, so it is obvious that they were not putting a
time limit on the sale of pre April 1994 scanners.
