When I bought my present house, the real estate agent
had no idea about any restrictions concerning this
property. After a lot of digging they were uncovered.

Then I suggest, your agent sucks, your title company sucks, and your closing
agent sucks. To be enforceable, conveants must be a matter of record and
real estate professionals have an obligation to search the records.
