CC: FCC Southeastern Regional Director April 28, 2003 Source: ARRL Letter ENFORCEMENT: AMATEUR AUXILIARY ASKED TO ASSIST FCC IN 10 METER CLEAN-UP Back on Mother Earth, the FCC has asked the assistance of the ARRL' s Amateur Auxiliary as part of a clean-up of illegal users of the 10 meter band. In a memorandum issued on April 28th, FCC Special Counsel Riley Hollingsworth, K4ZDH, asks the Auxiliary's help for the next 6 months in identifying any unlicensed operation using the 10 meter Amateur spectrum. From May through October Auxiliary members will be tasked with monitoring the band to determine whether interlopers are domestic business entities. This includes trucking companies, truckers or other individuals who are not licensed to be in the band or simply not licensed at all. The FCC is not requesting that Auxiliary members provide direction finding. Hollingsworth does ask that where possible that Auxiliary members provide the names and cities of the operators, and license plate numbers and state if the interfering signal is coming from a vehicle. The project has been assigned case number 2003-583 and Hollingsworth does ask Auxiliary members to use their best judgment as to whether to include tape recordings of what they monitor. Authority to use the ham radio volunteers in this investigation comes under the terms of long standing agreement between the FCC's Field Operations Bureau and the American Radio Relay League. You are requested to contact me at 717-338-2502 to discuss this matter. **************************************** This is 3 at once: NEWINGTON, CT, Jul 28, 2003--The FCC Enforcement Bureau has sent Warning Notice letters to three highway transportation firms asserting that drivers of some of their vehicles may have transmitted without a license on 10 meters. All three notices allege the unlicensed operations took place July 8 on Interstate highways in South Carolina. Letters went out July 14 from FCC Special Counsel Riley Hollingsworth to Jolly Roger Capital Ltd of Columbia, South Carolina, Tidewater Transit Company of Kinston, North Carolina, and Shuford Lumber of Marion, North Carolina. He warned all three firms that operation of radio transmitting equipment without a license could lead to fines of up to $10,000, equipment seizure and even imprisonment. Hollingsworth cited "information before the Commission" that spelled out each vehicle's highway location, license plate and--in two instances--operating frequency (28.085 MHz). One of the Warning Notice letters also identified the make and year of the vehicle. The alleged offenses were said to have occurred when the vehicles were under way on Interstate 77 or Interstate 20 in South Carolina. Your truck bearing license plate ZB20189 was monitored transmitting on Ten Meter frequencies on July 19, 2001 at 10:30 a.m. on U.S. 1 near Cary, NC, at 2:50 p.m. on Kildaire Farm Road and from 3:00 to 3:30 p.m. from a landfill near the intersection of State Road 55 and Sunset lake Road. Re-transmissions of Nextel two-way communications were also sent from the truck on Ten Meter frequencies. These notices appear at an irregular interval, but can also be found there under "ARRL Letter" published each Friday. Sometimes, they also are on www.arnewsline.com. and www.rainreport.com. which is published every two weeks. This push to end the incursions into bands by illegals is REAL and it's not going to stop. Yell at me all you like, I didn't start it. It was started when people decided that they could just do anyway they like. It isn't only the US hams that are upset, it is caused by complaints by OTHER countries who also are assigned 10/12 Meters by treaty. From what I am hearing, it is not going to just go away. The busts are increasing--including those against "freebanders" (there IS no such thing), and if it isn't curtailed, there are studies going on right now with FCC to best deal with it This is just the first shots over the bows.
