![]() I was just checking up on this topic and I we just had a major development. As you may be aware, there are two fronts going with K1MAN. First there is the issue with the renewal application which was set aside for review. This hearing was put on hold pending the outcome of the second issue. The second is the court case where the FCC is trying to collect 17,000 in fines. A few weeks ago, the judge in the first case issued a summary judgement for 10,000 of the 17,000 fine and held 7,000 in over for trial. (The judge had previously dismissed K1MAN's counter claim.) The government asked that the judge just give them $10,000 and call the rest done. As of last week the judge did just that, ordering K1MAN to pay $10,000 in fines. I'm sure an appeal will be attempted, but the judgment is final. This means that unless the appeals court is somehow willing to consider K1MAN's legal ramblings, he owes $10,000 and the FCC has a court order to prove it. This should free up the process for the renewal hearing before the administrative law judge in fairly short order. Once this hearing gets scheduled, it's likely to be a pretty open and shut case given the FCC has multiple warning notices, a NAL and a court imposed fine as evidence. I'm guessing the FCC will win this hearing and the renewal will be finally denied. We are one step closer.... It looks like we are closer to the end than the beginning. Unless the appeal court holds things up, or K1MAN can somehow gum up the works with the administrative hearing, we should be done with this by the end of the year, maybe even within 6 months? Man I hope so. |
