Rick Mish should be contacted to verify if Martyn's claims are true. If Martyn is trading off Rick's reputation and the work is NOT as described, Mish can legally have Martyn's ass for fraud, misrepresentation of Mish's work, harm to his reputation, and profiteering on Rick's name without permission. Then have Rick contact eBay about trading on his reputation without permission. THAT will get the job done. Suing Radio-Marty for misrepresentation would be like suing the retarted kid at the playground because he mumbles incoherent stuff about you. Nothing against retarted kids, sorry to compare them with Marty! But a not particularly useful experience for a well-respected professional to to one-up a retarded kid. Tim. Actually, it happens every day. On the private and the corporate level. Someone trading on another's reputation, is serious enough in itself. Misrepresenting products in another's name can have long term consequences to the business and personal reputation of the person who's reputation his being traded upon. Litigation, as distasteful as it may seem, is the only way to minimize that kind of damage. Often, however, the process never makes it to a courtroom. Once an action is filed, settlements often happen quickly. |
