Here's somethiong you forgot to paste. No, I was responding to the specific cite you provided. As to the following, you armchair lawyers love to find passages in the regs and apply them out of context. For example, reading the following makes me think that the FCC has erred every time they've fined Howard Stern and when they fined all the stations after the Janet Jackson brouhaha. Either they're wrong...or you are. Guess where my money is. From the U.S. Code Online via GPO Access [wais.access.gpo.gov] [Laws in effect as of January 7, 2003] [Document not affected by Public Laws enacted between January 7, 2003 and February 12, 2003] [CITE: 47USC326] TITLE 47--TELEGRAPHS, TELEPHONES, AND RADIOTELEGRAPHS CHAPTER 5--WIRE OR RADIO COMMUNICATION SUBCHAPTER III--SPECIAL PROVISIONS RELATING TO RADIO Part I--General Provisions Sec. 326. Censorship Nothing in this chapter shall be understood or construed to give the Commission the power of censorship over the radio communications or signals transmitted by any radio station, and no regulation or condition shall be promulgated or fixed by the Commission which shall interfere with the right of free speech by means of radio communication.
