Except for rights specifically given to citizens, like the right to vote,
all persons within the borders of the USA have guaranteed rights. Residents,
tourists, even illegal immigrants are given these rights and that is what
made the US rather unique in the world.

The documentation foreigners sign and agreed to grant specific rights to
what activities they can participate in and what time frame they can be
within our borders just like any other country. It could be a visa to
vacation here, a student visa or a work permit for example. These
examples permit the foreigner holding them to specific activities in
specific time frames. If the rules in the agreement granted are violated
they are deported.

If they do not have a student visa or work permit they better not be
doing either.

You must understand that these limited rights are granted by the
government and are not the inalienable rights the citizens have.

Foreigners that are undocumented have broken the law being here and so
as criminals (not following the rules) they are deported.

They must be assumed to be citizens until proved otherwise, due process
and all that gobbledegook.
